These Terms and Conditions are binding on all members, which should
visit this page periodically to review its contents for updates and changes.
Modifications to the Terms and Conditions shall become effective upon
publication and shall be binding upon all Users for any and all usage subsequent
to the published change. Violation of these Terms and Conditions shall be
grounds for suspension or termination of advertising privileges and deletion of
your account.
Members agree and
understand that there is NO GUARANTEE OF EARNINGS WHATSOEVER, and
AbraShares.com makes no claims of potential earnings.
ABRASHARES NOT AN INVESTMENT OPPORTUNITY, and makes no claims to
be such. We are an ADVERTISING company and as such deliver web site traffic to
our members based upon the advertising package they purchase.
AbraShares.com reserves the right to alter, modify or discontinue any
portion of our earnings program at anytime with or without notice.
Multiple Accounts
Users may NOT open multiple accounts. We are running periodic searches and if we find that a member has more than one account, their account will be permanently erased and their entire funds will be frozen.
Fraud
Members understands and agrees that, in the event of a security breach,
AbraShares.com reserves the right to reduce the account level or hold
any earnings incurred due to the 'increase' of the account level.
AbraShares.com makes every effort to ensure the security of the payment
process, but in the event of a "hacking",
AbraShares.com shall be held harmless for funds not received, and will
not be held liable to make restitution for funds mis-appropriated, redirected,
or stolen from user, due user fault.
Purchasing Ad Packs
User understands and
agrees that all Advertising Packs last 14 days from the time of purchase.
User agrees and understands that all money collected through the
AbraShares.com web site is for the expressed purpose of advertising a
specific advertisement to our members, and that they are PURCHASING advertising
credits in the amount of 10 full page views per $5.00 spent. Once
advertising credits are delivered upon completion of your transaction, all
revenue collected becomes the sole property of AbraShares.com. YOU ARE NOT INVESTING. User understands and agrees that
any transactions processed through the AbraShares.com web site are
e-commerce transactions for the sole purpose of exchanging money for specific
goods or services. User understands and agrees that Advertising
Packs can be purchased up to a maximum of $5,000.00.
Viewing Commissions
Advertisers have
the opportunity to participate in the viewing of premium and other members ads.
Advertisers who participate in this opportunity have the potential to
earn 10% for Upgraded Membership and 12% for VIP Membership of their personal membership level daily.
Participating users must actively view the ads every day; it is a violation of these our Terms
and Conditions to let the ads run without actively viewing them.
Viewing Commissions Payments
Users will be paid viewing commissions after advertising packs expires, within 24-48 hours.
Referral Commissions
Only Advertisers with
currently running advertising packages may earn additional income by referring
other advertisers to AbraShares.com. Referrals must be directed to
the program through the User's specific individual referral link to qualify.
For all Referral accounts, the User shall receive a commission of 5%, for each and
every Advertising Package purchased by their referral. This bonus
commission shall continue each time their referral purchases any additional
Advertising Packages, for as long as the Referring User maintains an active
Advertising Package.
Appropriate and Permitted Use of the AbraShares.com Web Site
Users may not, under any
circumstances, use this AbraShares.com web site to post or
transmit any material of an adult, infringing, threatening, abusive, hateful,
harassing, obscene, pornographic, profane
nature that could constitute or encourage conduct that would be considered a
criminal offense, give rise to civil liability, or otherwise violate any law.
Prohibited Sites
Web sites with adult
content, offensive material, auto installers, war mongering, frame
freezer, rotator, redirect, subscription email, multiple or viral
pop-ups are absolutely prohibited and not acceptable. All members are urged to use the Abuse Report link located on the surf bar to report any site that is in violation of our policy.
We want to make AbraShares.com an enjoyable
place and ask members to respect other members’ rights. Members understand
and agree that submitting prohibited sites will be dealt with by management.
Repeat offenders will have their accounts terminated and web site
banned for breaking these terms and conditions, loosing all earnings
generated.
Anti-Spam Policy
AbraShares.com
does not tolerate spam in any form. User understands and agrees that
AbraShares.com considers any spamming by the User to be a breach of
these Terms and Conditions, and will result in the User’s account being terminated
by AbraShares.com. Any User who receives SPAM from a
AbraShares.com client should report this to AbraShares.com
immediately.
Security Policy
E-mail “spoofing” allows
hackers to send messages to people with information that looks like it came from
the official company. We will NEVER request your password, name, or
other such personal information by e-mail. Users are
prohibited from engaging in any activity that violates
the security of this AbraShares.com : logging into servers or accounts for whose use you are
not authorized; accessing data not
intended for your use; trying to test or scan the system or network for
vulnerabilities, or to breach security measures or authentication procedures
without authorization; attempting to interfere with service to any user, host or
network, submitting a trojan, virus, worm,
or any other software, overloading the system, “crashing” or “spamming”; sending
unsolicited email, including promotions of products or services;
falsifying any TCP/IP packet header or any part of the header information in any
email or newsgroup posting or impersonating someone else. Users are further

liable for any and all damages that may result from such prohibited activity to
AbraShares.com and any of its members; any

adversely affected by such prohibited activity.

Indemnification and Hold Harmless
User agrees to indemnify
and hold harmless AbraShares.com, employees, affiliates and representatives from and against any claim, cause of

any dispute with a third party result from or arise in connection with any use

software, or other technical malfunctions; disruptions or disturbances of any
other communications failures; or circumstances that may affect, disrupt, or

and shall not be held liable for, any damages to, or viral infection of, your

deny User the right to use our services. AbraShares.com reserves
the right to cancel or refuse service at our sole option and discretion
in the event that you have supplied us with information that we find to be
false or that conceals any details that could influence
the services we provide to you. User understands and agrees that
AbraShares.com shall not be held liable for any losses or damages that
may result from our refusal to provide you our services.
AbraShares.com may act, at its sole discretion, with respect to
user-submitted information that we deem necessary or appropriate if we believe
it may result in potential liability for us or that it may cause us to lose, in
whole or in part, the services of AbraShares.com’s Internet Service
Provider (ISP) or other suppliers.
Maintenance Fees
Under normal circumstances
a User’s account is held without any fees or deductions.
Severability
In the event that any
provision of these Terms and Conditions is determined to be unenforceable,
invalid, unlawful or void, by any court having competent jurisdiction, then said
provision shall be deemed severable from the remaining provisions and shall not
affect their validity and enforceability.
Governing Law and Consent to Jurisdiction
This Agreement and its
performance are governed by the laws of the country of USA. User hereby
consents and submits to the exclusive jurisdiction of the Courts located in the
nation of USA to resolve all disputes that may arise out of or is related to the
use of AbraShares.com under this Agreement.
Changes,
Revisions, and Modifications
AbraShares.com reserves the right to update or modify these Terms and
Conditions at any time, at its discretion or according to new circumstances
that may arise as a result of market, legal,or other change.
User acknowledges that any such revision or change will be binding and will take
effect immediately upon posting. User must abide by those revisions and
changes.
Consequently, we encourage all Users to review our Terms and Conditions from
time to time to ensure your continued understanding, knowledge, acceptance, and
compliance with them.
Refunds
Due to the
digital nature of our advertising delivery system no refunds are applicable
since your product is delivered immediately upon payment.
Acceptance
By accepting the Terms and Conditions as outlined herein, User indicates to
AbraShares.com that you have read and understand these Terms and
Conditions and will comply with them when using this AbraShares.com
web site and services covered and described herein.
Understanding & Agreement
